pay-as-you-go Terms of Service

1. Overview
Section titled “1. Overview”These terms apply to customers who use Smartix services on a Pay-As-You-Go basis. By creating an account, purchasing credits, or using any Smartix feature, you agree to these terms. Please read them carefully.
2. Service Access
Section titled “2. Service Access”Access to Smartix services is provided through the Smartix Studio platform. You must have an active account and agree to keep your login credentials secure. Smartix may update, modify, or improve the platform and related systems at any time. Further details can be found in our Service Level Agreement : www.smartix/uk/terms/ sla
3. Payment and Pricing
Section titled “3. Payment and Pricing”Use of Smartix services on a Pay-As-You-Go basis requires prepayment by purchasing credits through the Studio. Prices are shown in GBP and exclude VAT unless stated otherwise. Credits are deducted automatically as services are used. Credit purchases are non-refundable once payment is processed.
4. Invoices and Records
Section titled “4. Invoices and Records”Invoices are automatically issued when credits are purchased. They are available in your Studio account and sent to your registered email address. You are responsible for maintaining accurate billing information within your account.
5. Grace Period and Account Suspension
Section titled “5. Grace Period and Account Suspension”If your balance runs low, you may continue using services for a short grace period. Smartix reserves the right to suspend or restrict access once your balance is insufPicient. Smartix may, at its discretion, extend or reduce the grace period depending on usage history or payment activity.
6. Acceptable Use
Section titled “6. Acceptable Use”You must ensure your use of Smartix services is lawful and compliant with UK law, or the laws of any other country where services are used. Smartix must not be used for illegal, fraudulent, or misleading purposes. Smartix reserves the right to suspend or terminate access if these terms are breached or if activity is reasonably believed to be unlawful or harmful.
7. Support
Section titled “7. Support”Support for Monthly Contract customers is available through the Studio help system or email. Smartix will make reasonable efforts to provide timely assistance and maintain service continuity, though speciPic response times are not guaranteed. We aim to respond to general enquiries within two business days. Service critical issues will be handled outside of business hours and addressed as soon as possible.
8. Data and Privacy
Section titled “8. Data and Privacy”Smartix handles personal data in accordance with its Privacy Policy, available on the Smartix website. You are responsible for ensuring any personal data you upload or process using Smartix complies with all relevant laws, including UK and EU data protection legislation. Smartix encrypts individual pass data (using AWS KMS rolling keys), notiPications and messages and system logs for the highest possible level of security for your data. However, speciPic pass Pields may be held unencrypted (and hence searchable) if so conPigured by yourself. Please refer to our Privacy Policy www.smartix.uk/terms/privacy-ploicy for further details.
9. Intellectual Property
Section titled “9. Intellectual Property”All Smartix software, branding, documentation, and content remain the property of Smartix Ltd. You are granted a limited, non-transferable licence to use the platform for legitimate business purposes in accordance with these terms.
10. Termination
Section titled “10. Termination”You may stop using Smartix at any time. Smartix may suspend or terminate access for breach of these terms, unlawful use, or non-payment. Any unused credits will remain available unless your account is closed for breach of acceptable use.
11. Liability
Section titled “11. Liability”Smartix provides services on an “as-is” basis. While we make every reasonable effort to ensure reliability, we do not guarantee uninterrupted availability. Smartix is not liable for indirect loss, loss of proPit, or business interruption arising from use of the service. Total liability for any claim will not exceed the amount paid by you for services in the previous 30 days.
12. Changes to Terms
Section titled “12. Changes to Terms”Smartix may update these terms from time to time. Updated terms will be posted on the Smartix website and will apply from the date of publication.
13. Governing Law
Section titled “13. Governing Law”These terms are governed by and interpreted in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
